By purchasing from Spy Products Australia, you agree that you are solely responsible for ensuring your use of the product complies with the laws of your state, territory and any other jurisdiction in which you intend to use it.
Australian surveillance law — general guidance
Surveillance device laws differ significantly between Australian states and territories. The following is a non-exhaustive summary, not legal advice.
Listening / audio devices
In most Australian states it is unlawful to record a private conversation to which you are not a party without consent. In some states (e.g. NSW), recording a conversation to which you ARE a party may be lawful in limited circumstances (such as protecting your lawful interests). State laws vary — consult a solicitor.
Optical / video surveillance
Recording in private places (bathrooms, change rooms, bedrooms not your own) is an offence in every Australian state. Recording in public places is generally permitted but may breach other laws (workplace, anti-stalking).
Tracking devices
Generally lawful to track property you own (your own vehicle, your own equipment). Tracking a person without their knowledge, or a vehicle you do not own, is an offence in most jurisdictions.
Workplace surveillance
In NSW, the Workplace Surveillance Act 2005 requires employees to be given written notice at least 14 days before workplace surveillance commences (with limited exceptions for covert surveillance authorised by a magistrate). Other states have similar laws.
Trade and professional buyers
Licensed investigators, security firms, insurance assessors and law-enforcement bodies operate under specific exemptions and obligations that may permit otherwise-restricted use. Operate within the limits of your licence.
What we will not sell
We refuse sales where we have reasonable cause to believe the intended use would breach Australian law, including but not limited to: stalking, harassment of an estranged partner, recording in private spaces of a third party, or attempts to intercept telecommunications.
